As the article says, some rando is suing Bungie for allegedly using his WordPress story posted back in 2013-2014 for the Red Legion storyline in D2. Some of his arguments seem plausible, others less so. The fact that D1 came out in 2014 and he only finished penning it that year means that some of his theft claims - specifically the idea of the exos, the collapse, and the original cabal couldn't have been copied; they would have to have been set in stone well before the game's release so that the devs could design around them.
Personally I think this guy is just a shark circling around Bungie, smelling blood and looking for a quick out-of-court settlement. What are your thoughts?

Edited by Lord Mirror Void: 10/6/2024 11:48:03 PMI feel its a waste of time and money. As there is no way they have been under a rock that long to just now know of Red War... i believe you are right and its someone trying to making a play because they think they think get a quick buck.

I've always hoped someone would actually be stupid enough to sue Bungie, but this is even better than I imagined lol

Having read through the side-by-side comparison of story elements presented within the full text of the lawsuit, I feel the list is hopelessly bloated with a mixture of descriptions of war lifted from real-world examples* as well as a number of narrative decisions so obvious that they are borderline logical necessities**. The fact that the provided list has been padded with so many weak examples of similarities between the two works suggests in my opinion that plaintiff’s counsel believed the list of grievances was otherwise far too sparse to be actionable. As a layman who occasionally reads through lawsuits and other legal documents, I’m currently unimpressed by what is presented here. * The use of scorched-earth tactics by an invading force, battles among ruined cityscapes, battles occurring on multiple fronts simultaneously, the invading force being led by an individual with an outsized view of their own importance while also feeling “superior” to the defending forces. ** An individual of low social standing rises to control an Empire with help from someone more versed in political intrigue, the invading alien force is well-trained militarily, the militaristic space-faring force uses encryption in their communications, an emergency broadcast is made to warn the populace that an invasion is taking place. Definitely someone just trying to get a pay day. You're telling me that they waited until now to sue bungie over the Red War story? 7 years after release and 4 years after it was removed from the game?

If that's the case then the emperor and darth vader are really going to have a bone to pick with bungie. I'm just not seeing it myself. "My story had a super weapon, their story had a super weapon." "My story had war dogs, the cabal have war dogs." Klingons also had war dogs and lots of things have super weapons and war dogs.
